1 · Acceptance of Terms and Site Usage Rules

By accessing or using this website, you agree to these Terms of Service. If you do not agree, please do not use the Site.

You agree to use the Site lawfully and not to:

• Submit fraudulent or misleading information;
• Attempt unauthorized access to any part of the Site, portal, or account;
• Introduce malicious code;
• Scrape or copy Site content without authorization;
• Use bots or automated tools to collect information from the Site;
• Interfere with the security or operation of the Site; or
• Otherwise misuse the Site.

2 · About Hire Inside Bloom and Our Recruiting Model

Hire Inside Bloom LLC is a nationwide direct-hire recruitment and talent acquisition firm connecting employers with qualified professionals for permanent employment opportunities. Our services are:

• Direct-Hire Recruiting;
• Specialized & Hard-to-Fill Recruiting;
• Executive Search; and
• Recruitment Process Outsourcing (RPO).

Hire Inside Bloom is not a temporary staffing company and does not provide temporary, contract, or contract-to-hire staffing.

When a candidate is hired through Hire Inside Bloom, that candidate becomes an employee of the client organization. Hire Inside Bloom is a recruiting intermediary and is not the employer of a placed candidate.

Accordingly, Hire Inside Bloom does not employ placed candidates, does not act as an employer of record, does not control or supervise a placed candidate’s day-to-day work, does not set wages, benefits, or working conditions after placement, and does not become a party to the employment relationship between the client and the candidate.

3 · Job Opportunities and Direct-Hire Placement

Job opportunities appearing on the Site may be posted by Hire Inside Bloom or presented in connection with a client recruiting engagement. Job information may include the position title, responsibilities, qualifications, location, compensation information, work arrangement, and application instructions.

Job information may change at any time. Positions may close, be filled, be cancelled, or otherwise become unavailable without notice, and Hire Inside Bloom does not guarantee that a listed position remains open.

• Applying does not guarantee an interview;
• An interview does not guarantee an offer;
• Being presented to a client does not guarantee employment; and
• Final hiring decisions belong to the client.

4 · User Accounts, Applications, Resumes, and Submissions

You are responsible for the information you submit through the Site, including resumes, applications, contact information, professional history, credentials, and other recruiting information. You represent that the information you provide is accurate and that you have the right to submit it.

Candidates retain ownership of their resumes and personal information, subject to the permissions necessary for Hire Inside Bloom to provide recruiting services. By submitting a resume or application, you grant Hire Inside Bloom a limited right to use and share that information as reasonably necessary to:

• Evaluate your background for relevant opportunities;
• Communicate with you;
• Consider you for current and future openings;
• Present you to potential client employers; and
• Administer our recruiting activities.

This permission is limited to those purposes and is subject to our Privacy Policy. If you hold an account or portal login, you are responsible for maintaining its confidentiality and for activity that occurs under it.

5 · Client Job Postings and Employer Submissions

Client organizations may provide job descriptions, position requirements, compensation information, hiring requirements, recruiting requests, and other information needed to conduct a search.

Clients are responsible for the accuracy and legality of the information they provide and must not knowingly request discriminatory recruiting practices. Hire Inside Bloom may decline, remove, edit, or restrict a posting, submission, or recruiting request that violates applicable law, these Terms, or our policies.

6 · Intellectual Property and Website Content

The Hire Inside Bloom name, logos, branding, website design, text, graphics, original content, and proprietary materials are owned by Hire Inside Bloom LLC or its licensors and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or commercially exploit our proprietary website content without our written permission. Candidate resumes and client-provided job descriptions remain subject to their respective ownership rights and the limited licenses described in these Terms.

7 · Acceptable Use

You agree not to use the Site for:

• Unlawful activity or fraud;
• Impersonation or harassment;
• Introducing malicious code or attempting unauthorized access;
• Scraping or automated collection without our permission;
• Misuse of candidate or client information;
• Interfering with the operation of the Site;
• Submitting false job postings;
• Submitting another person's information without authorization; or
• Unlawful discrimination.

8 · Privacy and Personal Information

Personal information submitted through the Site is handled in accordance with our Privacy Policy, which describes what we collect, how we use it, and the choices available to you.

Candidates often submit detailed professional and contact information as part of a search. Please review the Privacy Policy before submitting information to us.

9 · Disclaimers and Recruiting Outcomes

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Hire Inside Bloom disclaims warranties of any kind regarding the Site, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Hire Inside Bloom does not guarantee:

• Employment or placement;
• An interview or presentation to a client;
• Hiring by any client;
• Job availability or continued availability of a posted position;
• Any particular compensation; or
• The accuracy or completeness of third-party job postings.

Hire Inside Bloom does not guarantee any particular recruiting outcome. To the fullest extent permitted by applicable law, Hire Inside Bloom is not liable for indirect, incidental, special, or consequential damages arising out of your use of the Site. Nothing in these Terms limits liability that cannot be limited under applicable law.

10 · Recruiting Engagements and Commercial Agreements

These Terms govern use of the website. They do not themselves create a recruiting engagement between Hire Inside Bloom and an employer.

Commercial recruiting terms are governed by the written agreement or proposal executed between Hire Inside Bloom and the client, which may address placement fees, payment schedule, invoice terms, payment options, replacement guarantees, candidate introduction periods, search scope, Recruitment Process Outsourcing (RPO) services, and other service-specific terms.

Where an executed recruiting agreement or proposal exists, that agreement controls the commercial relationship between Hire Inside Bloom and the applicable client to the extent of any conflict regarding the recruiting engagement.

11 · Payments, Invoices, and Billing

Invoices issued by Hire Inside Bloom are governed by the applicable recruiting agreement. The invoice date and payment due date are identified on the invoice and in the employer portal.

Billing questions should be submitted in writing and include:

• The invoice number;
• The disputed item; and
• An explanation of the issue.

Changes to payment arrangements are effective only when agreed in writing.

12 · Third-Party Websites and Services

The Site may link to or rely on third-party websites and services, including job boards, social platforms, payment providers, and scheduling tools. Hire Inside Bloom is not responsible for the content, availability, policies, security, accuracy, or practices of those third parties.

Review the third party’s own terms and privacy policy before using its service.

13 · Messaging and SMS Terms

Program: Hire Inside Bloom recruiting and service messages.

You opt in by affirmatively checking the SMS consent checkbox on an applicable Hire Inside Bloom form.

Consent is optional and is not a condition of applying for employment, being considered for employment, receiving recruiting services, or purchasing services.

Messages may include recruiting communications, interview scheduling, application updates, search updates, document requests, responses to your inquiries, and other service-related communications.

Mobile opt-in data and consent records are not sold or rented and are not shared with third parties for their own marketing purposes.

14 · Termination or Restriction of Website Access

Hire Inside Bloom may restrict, suspend, or terminate access to the Site or the employer portal when it reasonably believes a user has violated these Terms, applicable law, or our security requirements.

Restricting website access does not, by itself, terminate an executed recruiting agreement. Termination of a recruiting engagement is governed by that agreement.

15 · Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Subject to applicable law, the state and federal courts located in Dallas County, Texas have exclusive jurisdiction over disputes arising from these Terms or your use of the Site.

Before initiating litigation, we ask that you raise the matter with us in writing at Terms@HireInsideBloom.com and allow a reasonable opportunity to resolve it informally.

16 · Changes to These Terms

We may update these Terms from time to time. When we do, we update the “Last updated” date at the top of this page, and where a change is material we take reasonable steps to make the update apparent. Continued use of the Site after the changes take effect may constitute acceptance where legally appropriate.
